corporate subscription by citizenM

1. Scope

These terms and conditions apply to the corporate subscription agreement between collectionM B.V. (“citizenM”) and you and the associated bookings and use of hotel rooms and meeting rooms (societyM) in any citizenM hotel, to the exclusion of any other party’s terms and conditions.  In addition, each guest booking a room under this corporate subscription agreement will be required to accept citizenM’s general terms and conditions at the time of booking.

2. Benefits

The  subscription benefits offered under the corporate subscription agreement consist of:

  • up to 3 nights per calendar month, which can be booked in any citizenM hotel  - guaranteed availability for bookings made up to 24 hours prior to arrival, thereafter based on availability;
  • breakfast included for every night stayed;
  • one courtesy welcome drink with each stay, regardless of duration;
  • one additional person in room is permitted - breakfast fee to be charged for additional guest;
  • 3 hours of use of a meeting room with maximum capacity of 8 persons (4 persons while covid-19 restrictions apply) per calendar month, which can be booked in any citizenM hotel with meeting rooms -  meeting room use based on availability;
  • meeting room use must be booked as 1 block of 3 hours - booking of meeting rooms in multiple blocks is at citizenM’s discretion and can only be requested for same day use; and
  • daily workspace in the living room of any citizenM hotel during the subscription period.

Any additional room nights, meeting room hours, day passes and F&B must be purchased separately. The subscription benefits are personal to your designated employees and cannot be transferred. 

3. Taxes

The corporate subscription fee is excluding Dutch VAT at a rate of 21% and inclusive of any other taxes, such as city tax and state tax.

4. Payment

If you purchased a monthly subscription, we will send you a payment link to pay the subscription fees. If you purchased an annual subscription, you can pay, at your discretion, via either a payment link or a bank transfer. 

The subscription benefits will be made available (i) upon receipt of payment if you have used the payment link that we sent you or (ii) no later than seven days after we have received payment if you have chosen to pay via a bank transfer; provided that nights and use of meeting rooms can only be booked in the calendar month following the month in which the payment has been processed, if the subscription does not start on the first day of the month. 

5. Renewal and cancellation

Your subscription will automatically renew at the end of the applicable subscription period, unless you cancel your  subscription before the end of the then-current subscription period by: (i) notifying us at least two weeks prior to  the expiration of the then-current subscription period, in the case of a monthly subscription, or (ii) notifying us at least one month prior to  the expiration of the then-current subscription period, in the case of an annual subscription. The cancellation will take effect the day following the last day of the then-current subscription period.

We can cancel your subscription at any time for any reason. If we cancel your subscription before the end of the then-current subscription period, we will refund any subscription fees already paid to us in proportion to the number of days  expired of the then-current subscription period.

6. Unused subscription benefits

In the case of a monthly subscription, any subscription benefits not used at the end of the month expire and will not be transferred to the following month(s). In the case of an annual subscription, any subscription benefits not used at the end of the month may be transferred to the following month and if not used at the end of the following month will expire and will not be transferred to the month(s) thereafter. We will not refund any subscription fees already received by us on the basis of unused benefits.

7. Check-in (hotel rooms)

Check-in is from 2.00 PM onwards. If a room is available for early check-in, guests can check in early. 

8. Check-out (hotel rooms)

No later than 11am. If guests have not checked-out by 11am, a late check-out fee may be charged to your credit card on file. If guests have not checked-out by 4.00 PM we may charge an extra night.

9. Food & beverage

Food and beverage from outside vendors are not allowed to be consumed within societyM meeting rooms or the public areas of any citizenM hotel. We reserve the right to add a cover charge of an amount equal to an equivalent product available in our hotel if this term is violated.

10. Age

We reserve the right to evict guests who are under the age of 18 and are not accompanied by someone of age 18 or older from the hotel. 

11. Pets

Pets other than service animals are not permitted. Emotional support animals do not qualify as service animals. If you or your party needs the assistance of a service animal during your stay, please notify us in advance of your arrival.

12. No smoking, vaping & alcohol

Smoking and vaping are not permitted inside the hotel. If smoking or vaping is detected we will charge you a fine of €150.  We reserve the right to not serve alcohol.

13. Damage to hotel

Any damage to rooms, meeting rooms or the hotel premises caused by guests during their stay and items missing upon their departure will be charged to the guest.

14. Lost and found

You acknowledge and agree that citizenM cannot be held liable for lost, damaged or stolen items. If guests leave an item behind, it is their own responsibility to retrieve such item.

15. Wi-Fi

Our wireless network is provided “as is” without warranties of any kind, whether express, or implied or statutory. We do not warrant that access to our wireless network will be uninterrupted, timely, secure or error-free at all times or will meet our guests’ requirements. We are not responsible for the security, integrity, accuracy or completeness of any information that guests transmit or receive while using our wireless network. 

Our wireless network is provided to our guests at our discretion. Guests’ access may be blocked, suspended or terminated for any reason.

Guests may not (i) use our wireless network for any purpose that is unlawful or otherwise prohibited, (ii) use our wireless network in such a manner as to host a web or other server, send or facilitate the sending of bulk e-mail or collect third party personal data without appropriate consent, (iii) exceed typical bandwidths relevant to the period that guests use our wireless network, (iv) resell, or attempt to resell, our wireless network to any third party.

We maintain a log of technical traffic data of our guests’ usage activity for system performance, maintenance purposes, for the purpose of processing criminal offences and system security requirements. We process personal data collected by us in connection with our guests’ use of our wireless network is subject to our Privacy Statement. By using our wireless network you consent to such processing. 

16. Recording and photography

Any audiovisual recording, photo shoot, reproduction or representation of images including the premises and buildings of the hotel other than for strictly private use is subject to our prior approval. Permission can be obtained by contacting us at press@citizenM.com. 

17. Liability of citizenM

This clause 17 and clause 18  set out citizenM's entire liability in respect of any breach of these terms and conditions and any representation, statement or tortious act or omission including negligence arising under or in connection with these terms and conditions. Our liability to you and our guests for any loss or damage in contract or tort, including negligence, will not exceed the amount of the charges paid by you to us. We will also not be liable for any special, indirect or consequential loss or damage, however arising (including negligence).  Nothing in these terms and conditions will exclude or restrict either party's liability in respect of death or personal injury resulting from its negligence, or for fraudulent misrepresentation.

18. Force majeure

citizenM does not accept liability or pay any compensation for any breach of these terms and conditions or delay or failure to provide services contracted due to circumstances beyond our control, such as acts of God, (natural) disaster, pandemic or epidemic, fire, (acts of) war and terrorism, strikes, riots, civil disorder, governmental regulations, industrial disputes, adverse weather conditions or any other exceptional and catastrophic event, circumstance or emergency, delays in transportation, failure of services or inability to obtain any necessary information or consent from any authority. 

19. Privacy

During the reservation process, our guests’ stay citizenM collect their personal data. These data are processed in accordance with our Privacy Statement and also according to any applicable laws and regulations.

20. Changes

We may change our subscription plans, including but not limited to the subscription benefits and rates and these terms and conditions, from time to time. We will communicate any changes to you in advance of such changes going into effect. Changes will take effect at the start of the next subscription period following the date of the change. You accept the change by continuing your subscription after the change takes effect. If you do not agree with a change, you have the right to reject the change by cancelling your subscription prior to the change going into effect.

21. Governing law and jurisdiction

These terms and conditions and any subscriptions purchased under them will be governed by and construed in accordance with Dutch law. This choice of law is without prejudice to consumer protection afforded by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of any choice, would have been applicable in the country where you reside.

All disputes arising from or in relation to this will be settled exclusively:

(a) if your place of business is in the European Union, by the competent court in The Hague, the Netherlands;

(b) if your place of business is outside of the European Union, by arbitration. The arbitration will be conducted in accordance with the rules of the Netherlands Arbitration Institute (Nederlands Arbitrage Instituut). The place of arbitration will be The Hague, the Netherlands. The arbitration will be conducted in the English language. There will be one arbiter which will be appointed in accordance with the list procedure provided for in article 14 of the rules. The arbiter will decide on the basis of the law of the Netherlands.
