These terms and conditions apply to the Global Passport Agreement between collectionM B.V. (“citizenM”) and you and the associated bookings and use of hotel rooms in any citizenM hotel, to the exclusion of any other party’s terms and conditions. In addition, you will be required to accept citizenM’s general reservation terms and conditions at the time of booking.
The Global Passport benefits offered under the Global Passport Agreement per month consist of:
- Stay 30 consecutive days (29 nights) in any of our citizenM hotels
- Maximum of 30 consecutive days and minimum of 7 consecutive nights booking at one hotel
- On availability basis per specific hotel - no blackout dates
- Superfast free Wi-Fi available in all hotels
- Unlimited use of living rooms for work, rest and play
- 25% discount on all food and drinks (including our cloudM rooftop bars)
- All 21 citizenM hotels included worldwide (more coming in 2021)
- Booked nights can be cancelled up until 2.00 PM on day of arrival
Any additional room nights, meeting room rentals, gift shop items, food and beverage, long term or bulk storage, mail services, and additional housekeeping must be purchased separately unless agreed otherwise.
3. Rates & taxes
The following Global Passport rates per night will apply to your bookings:
USD 50 for our hotels in the USA
EUR 50 for our hotels in the Netherlands and France
GBP 50 for our hotels in the UK
CHF 60 for our hotels in Switzerland
DKK 400 for our hotel in Copenhagen
TWD 1,400 for our hotel in Taiwan
MYR 165 for our hotel in Malaysia
The Global Passport rates include VAT but exclude local taxes, such as city occupancy tax and state tax.
4. Deposit & payment
We will send you a payment link to pay via credit card a deposit of EUR 750 together with the Global Passport Agreement. Your Global Passport(s) will be available to be activated and you can start making use of the Global Passport benefits upon receipt of payment of the deposit and signed Global Passport Agreement. Within 14 days of your last stay we will refund the deposit less any open balances and any other amounts charged to you pursuant these terms and conditions and citizenM’s general reservation terms and conditions.
The applicable Global Passport rate will be payable at check-in.
5. Unused benefits
Your Global Passport and associated benefits will expire on 31 September 2021. You must book 29 consecutive nights starting from the first date of stay indicated by you. We will charge you EUR 50 for each unused night upon expiration of your Global Passport or if you did not stay 29 consecutive nights, with a maximum of EUR 750, and will take the aggregate charge from your deposit.
We will extend the 30 consecutive days period with the number of days during this period that you cannot travel from your place of residence to more than 4 cities in which we operate due to travel restrictions imposed by local governments.
6. Cancellation by you
If you have purchased consecutive Global Passports, you may cancel your Global Passport at any time after 30 days from the start date indicated by you and we will refund the balance of your deposit.
7. No permanent stay
We do not offer permanent accommodation. The length of stay is restricted to a maximum period of 29 nights. After the expiration of your booking you must check-out. We reserve the right to evict you if you extend your stay beyond your booking.
8. No transfer or resales
The Global Passport benefits are unique to you and you only. Any and all transfers or resales of the Global Passport benefits are prohibited. The Global Passport holder must also be the user of the Global Passport benefits and may be requested to provide identification at check in. In case of violation of our transfer and resale policies the Global Passport Agreement will be terminated with immediate effect and open bookings will be cancelled without any compensation being due and your full deposit will be forfeited.
9. Maximum occupancy
Each room has a maximum occupancy of two persons. Please note only one guest in addition to the Global Passport holder is permitted in the room. The Global Passport holder must always check in and be the primary occupant. In case of violation of our maximum occupancy and other guest policies the deposit will be forfeited.
10. Room change
We may require you to be transferred to another room during your stay for operational reasons.
11. Food & beverage
Food and beverage from outside vendors are not allowed to be consumed within societyM meeting rooms or the public areas of any citizenM hotel. We reserve the right to add a cover charge of an amount equal to an equivalent product available in our hotel if this term is violated.
12. Liability of citizenM
This clause 12 and clause 13 set out citizenM's entire liability in respect of any breach of these terms and conditions and any representation, statement or tortious act or omission including negligence arising under or in connection with these terms and conditions. Our liability to you and our guests for any loss or damage in contract or tort, including negligence, will not exceed the amount of the charges paid by you to us. We will also not be liable for any special, indirect or consequential loss or damage, however arising (including negligence). Nothing in these terms and conditions will exclude or restrict either party's liability in respect of death or personal injury resulting from its negligence, or for fraudulent misrepresentation.
13. Force majeure
citizenM does not accept liability or pay any compensation for any breach of these terms and conditions or delay or failure to provide services contracted due to circumstances beyond our control, such as acts of God, (natural) disaster, pandemic or epidemic, fire, (acts of) war and terrorism, strikes, riots, civil disorder, governmental regulations, industrial disputes, adverse weather conditions or any other exceptional and catastrophic event, circumstance or emergency, delays in transportation, failure of services or inability to obtain any necessary information or consent from any authority.
During the reservation process, our guests’ stay citizenM collect their personal data. These data are processed in accordance with our Privacy Statement and also according to any applicable laws and regulations.
15. Changes & cancellation by citizenM
We may change the terms and conditions of the Global Passport, including the Global Passport benefits, from time to time. We will communicate any changes to you in advance of such changes going into effect. If you do not agree with a change, you have the right to reject the change by requesting a cancellation of your Global Passport prior to the change going into effect. We will provide a full refund of your deposit in the event you reject the change caused by citizenM different to the terms and conditions provided at purchase.
We can cancel your Global Passport at any time for any reason. If we cancel your Global Passport before the end of the Global Passport period, you can still make use of your open bookings and we will refund your deposit.
16. Governing law & jurisdiction
These terms and conditions and any Global Passport purchased under them will be governed by and construed in accordance with Dutch law. This choice of law is without prejudice to consumer protection afforded by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of any choice, would have been applicable in the country where you reside.
All disputes arising from or in relation to this will be settled exclusively:
(a) if your place of business is in the European Union, by the competent court in The Hague, the Netherlands;
(b) if your place of business is outside of the European Union, by arbitration. The arbitration will be conducted in accordance with the rules of the Netherlands Arbitration Institute (Nederlands Arbitrage Instituut). The place of arbitration will be The Hague, the Netherlands. The arbitration will be conducted in the English language. There will be one arbiter which will be appointed in accordance with the list procedure provided for in article 14 of the rules. The arbiter will decide on the basis of the law of the Netherlands.
